Employment Litigation

Betts Diplas PLLC has extensive experience representing both companies and individuals in employment disputes with serious financial, regulatory, and reputational consequences.

Our practice spans workplace discrimination, harassment, and retaliation claims; disputes over restrictive covenants, including non-compete, non-solicitation, and non-disclosure agreements; compensation and severance issues, particularly in executive transitions; wage and hour litigation; and whistleblower actions. We also conduct internal investigations and represent individuals involved in critical employment and governance matters.

We have represented clients in employment-related matters across diverse industries such as life sciences, healthcare, finance, and consumer products, and have litigated claims under federal, state, and administrative law, including Title VII, the ADA, the FLSA, and their state-law equivalents. Having represented both plaintiffs and defendants, we are distinctly qualified to navigate sensitive negotiations and adversarial proceedings.

Representative matters include:

  • Litigating discrimination claims based on race, gender, disability, age, and national origin;
  • Advising a biotechnology company in disputes concerning alleged employee misclassification under the FLSA and state laws;
  • Negotiating separation agreements and transition plans for senior executives at fintech and biotechnology companies;
  • Representing an arts center in settlement negotiations with the New York State Department of Labor involving wage and hour claims affecting large groups of employees;
  • Advising on and negotiating the scope and enforceability of non-compete clauses in the finance and healthcare industries;
  • Representing medical services and telecommunications companies in qui tam whistleblower investigations;
  • Conducting board-level internal investigations of officers and directors in connection with employment, governance, and fiduciary-duty issues for life sciences and consumer products companies; and
  • Reviewing company policies in the medical services sector for compliance with federal regulations.

Certain matters described above were handled by Michael A. Betts and/or Alexandros Diplas prior to the formation of Betts Diplas PLLC.
